1. Acceptance of Terms
By accessing and using drewtheadjuster.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Site.
These Terms apply to all visitors, users, and anyone else who accesses or uses the Site. We reserve the right to modify these Terms at any time, and your continued use of the Site following any changes constitutes your acceptance of those changes.
2. Nature of Services
Drew the Adjuster is a public adjusting firm that represents policyholders — homeowners and property owners — in the preparation, negotiation, and settlement of property damage insurance claims. We do not represent insurance carriers, government agencies, or any entity other than our clients.
Our services on the Site are informational in nature. Using the Site or submitting a contact form does not create an attorney-client, adjuster-client, or any other professional relationship. A formal engagement is only formed when a written Client Engagement Agreement is signed by both parties.
3. No Guarantee of Outcomes
While we strive to achieve the best possible outcome for every claim, we do not guarantee any specific result. Insurance claim outcomes depend on numerous factors beyond our control, including:
- Policy language, terms, conditions, and exclusions
- Insurance carrier decision-making
- Scope and severity of damage
- Applicable state laws and regulations
- Timeliness of reporting and documentation
- Third-party assessments and inspections
Any statements about past settlements or success rates are for informational purposes only and should not be interpreted as a guarantee of future results.
4. Use of the Site
You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use of the Site. You agree not to:
- Use the Site in any way that violates applicable federal, state, or local law
- Transmit any material that is defamatory, offensive, or otherwise objectionable
- Attempt to gain unauthorized access to any portion of the Site, other accounts, or computer systems
- Use automated tools (bots, scrapers, crawlers) to access or extract data from the Site
- Interfere with or disrupt the Site's functionality or servers

The Site and all content, services, and products available through it are provided on an "as is" and "as available" basis without any warranties of any kind, whether express, implied, statutory, or otherwise. Drew the Adjuster makes no warranty that:
- The Site will be uninterrupted, secure, or error-free

Our total aggregate liability arising from or related to these Terms or your use of the Site shall not exceed the amount you have paid us for services giving rise to the claim, or $100, whichever is greater.
8. Indemnification
You agree to indemnify, defend, and hold harmless Drew the Adjuster and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Site

9. Client Engagement Agreements
The Terms on this Site govern your use of drewtheadjuster.com and are separate from any Client Engagement Agreement you may enter into with Drew the Adjuster. If you engage us to represent you on an insurance claim:
- A written Client Engagement Agreement will be executed before we begin services
- The Engagement Agreement will govern the specific scope, fees, and terms of our representation
- In the event of a conflict between these Terms and the Engagement Agreement, the Engagement Agreement controls for the matters it covers
- Fee structures, licensing, and consumer rights are subject to state-specific regulations
10. State-Specific Disclosures
Public adjusting is regulated at the state level, and requirements vary significantly. Depending on the state in which you reside or where the property is located, you may be entitled to additional rights, disclosures, or protections, including:
- State licensing information for public adjusters
- Fee caps and permissible fee structures
- Right of rescission (cooling-off periods)
- Specific contract language requirements
- Consumer complaint procedures
We will provide all state-required disclosures at the time of engagement. This Site does not provide legal advice and should not be relied upon as such.
